• 08 Sep 2026Regen Biotech Inc. Obtains Favorable Ruling in Patent Invalidation Appeal For the convenience of customers, partners, and the public at large, Regen Biotech Inc. (hereinafter the “Company”) hereby announces, based on the trail decisions and judgments already rendered, the latest progress in the invalidation proceedings concerning Korean Patent No. 10‑1725279 (titled “Manufacturing method of polymeric microparticles having network structure”, hereinafter the “Subject Patent”), owned by Vaim Co., Ltd. (hereinafter “Vaim”). With respect to the Subject Patent, the Company duly filed a petition for a patent invalidation trial with the Korean Intellectual Property Trial and Appeal Board of Korea (IPTAB) in accordance with applicable laws. On August 5, 2025, the IPTAB issued a decision declaring the Subject Patent invalid. Subsequently, Vaim, dissatisfied with the invalidation decision, filed an action with the the Patent Court of Korea seeking revocation of that decision. On August 26, 2026, the the Patent Court of Korea, pursuant to law, dismissed Vaim’s claims, thereby upholding the IPTAB’s decision invalidating the Subject Patent. As of the date of this announcement, the Company has obtained a favorable outcome at the current stage of these proceedings. Under the statutory procedures governing Korean patent litigation, the judgment rendered by the the Patent Court of Korea at this time is a first-instance judicial decision and is not final or conclusive. The parties to the case have the right to appeal to the Supreme Court of Korea within the statutory time limit. The final outcome of this case will therefore depend on any such appeal and the subsequent adjudication by the Supreme Court of Korea. This announcement is made solely on the basis of the relevant legal documents that the Company has received and verified as of the date of publication, and is intended to objectively disclose the case progress. (hereinafter "Regen Biotech") acknowledges the recent ruling by the Supreme Court of Korea in the case ofVaim Co., Ltd. v. Regen Biotech Inc regarding a manufacturing method patent owned by Regen Biotech, which was rendered on October 15, 2025., which was rendered on October 15, 2025. The Supreme Court has upheld the previous decision issued by the Patent Court on June 5, 2025, dismissing the appeal filed by Vaim Co., Ltd (hereinafter "Vaim"). In its ruling, the Supreme Court carefully reviewed the records, legal arguments, and supporting documents presented during the proceedings. The Court determined that Vaim's appeal did not meet the legal requirements set forth in the Special Law on Appeal Procedures, leading to the dismissal of the appeal.
